Thank you for agreeing to participate in the trial of an early beta version of Depop’s Boosted Listings (the “Beta Product”). The Beta Product is intended to enable you to reach more buyers by promoting or “boosting” your listings in search on Depop’s website and mobile app. You understand this is a beta trial - things may break or not work as intended - but your participation and feedback can help Depop build a better product for you and the entire Depop community.
We will notify you when the trial of the Beta Product (the “Beta Trial”) commences and ends via email and in-app (the “Trial Period”). The Beta Product is offered to you free of charge for the Trial Period only. At the end of the Trial Period, any listings you selected to “boost” during the Trial Period will automatically convert to paid boosted listings. This means that if a buyer clicks on an item boosted by you during the Trial Period at any time after the Trial Period ends, and goes on to purchase this item within the 28-day attribution period, you will be charged an 8% boosting fee on the total transaction amount (including shipping costs), in addition to Depop selling fees and transaction fees. Following the end of the Trial Period, your use of the paid Boosted Listings product will be subject to the Boosted Listings Terms, which will be notified to you by email at the end of the Trial Period.
As always, all listings, including those that are boosted by you as part of the Beta Trial, must meet Depop’s standards. Per the Terms, boosted listings may not include content that violates our Rules of Acceptable Use (found at section 8 of the Depop Terms of Service) or the intellectual property rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights. If you violate Depop’s policies or any third party rights, you may lose your ability to boost listings on our platform, and Depop reserves the right to take any necessary actions against your shop under the Terms.
As laid out in the Terms, you are also responsible for ensuring that your listings comply with all applicable laws and regulations applicable in your jurisdiction.
Depop will work to deliver effective promotion of your boosted listings on the Depop mobile app and website as part of the Beta Trial. However, especially as a beta trial, Depop can make no guarantee that your boosted listings will be displayed in search results, a displayed boosted listing will be clicked, any click will lead to a purchase, or that your promotion goals will be met.
You acknowledge and agree that: (a) the Beta Product may not be reliable or fully functional during the Beta Trial, and may contain errors, design flaws or other problems, (b) the Beta Product is provided to you “as is” and, to the extent permitted by applicable laws, without any warranty of any kind, and (c) Depop is under no obligation to release a commercially available and/or paid version of the Beta Product.
You understand that as part of your participation in the Beta Trial, you may be exposed to Depop features or information that is not, and may never become, available to the public ("Confidential Information"). “Confidential Information” includes but is not limited to information provided to you regarding the Beta Trial, Beta Product and/or the paid version of Boosted Listings, as well as your feedback on any of these. Confidential Information does not include information that is generally known about Depop, information that you have legally obtained from sources other than Depop or persons with confidentiality obligations to Depop, or information that is or becomes available to the public through no act that violates this agreement. You agree to keep confidential and secret all Confidential Information. In other words, you agree you will not disclose Confidential Information with anyone, including but not limited to other Depop users. Depop considers a breach of confidentiality to be a material violation of the Depop Terms of Service.
We appreciate receiving your feedback about the Beta Trial. In exchange for your participation, you grant Depop the right to use your feedback (legally, it’s an irrevocable, perpetual, worldwide and royalty-free licence to use any of your feedback as permitted by law - but this doesn’t mean Depop owns it, just that we can use it). We need these rights to improve the Beta Trial based on your and others’ feedback, and make related products and services even better.
Depop reserves the right to: (a) end your participation in the Beta Trial, (b) change the terms of the Beta Trial with notice to you, (c) add, change or remove the services and/or functionality available through the Beta Trial, and/or (d) terminate the Beta Trial at any time. Depop will provide notice to you of any material changes.
These Beta Trial Terms may be modified at any time pursuant to Section 18 of our Terms of Service.
These Beta Trial Terms will automatically expire at the end of your participation in the Beta Trial, unless terminated sooner in accordance with the Terms.
